Privacy and “cookies” policy

  1. HOW WODGURU PROTECTS THE PRIVACY OF CUSTOMERS, USERS AND CLUB MEMBERS

    1. WodGuru uses due diligence to select and apply appropriate technical and organizational measures to ensure the protection of the personal data being processed. WodGuru secures personal data from being made available to unauthorized persons, as well as from being processed in violation of applicable laws and from being altered, lost, damaged or destroyed.

    2. All terms contained in the Privacy Policy should be interpreted in accordance with the definitions of the Terms and Conditions, located at: https://wod.guru/terms/

  1. BASIS FOR PROCESSING OF YOUR DATA BY SERVICE PROVIDERS

    1. The administrator of the personal data of the Customers within the meaning of the Regulation of the European Parliament and of the Council (EU) 2016/679 of April 27, 2016 on the protection of natural persons in relation to the processing of personal data and on the free flow of such data and repealing Directive 95/46/EC (hereinafter referred to as the “Regulation”) is WodGuru, i.e. Tomasz Szadkowski conducting business activity under the firm Tomasz Szadkowski WodGuru at the address: 8/20 Wiejska Street, on the basis of an entry in the Register of Entrepreneurs of the Central Registration and Information on Business Activity, under the number NIP 6731847352, REGON 365182946, e-mail address: info@wod.guru. The Administrator of Users’ and Club Members’ personal data is the Customer, but on the basis of the relevant Data Processing Entrustment Agreement concluded with the Customer, WodGuru processes Users’ and Club Members’ personal data.

    2. The scope of entrustment of data by the Customer is determined by the Customer on a case-by-case basis and depends on the type of Services covered by the Agreement between WodGuru and the Customer and the individual use of these Services by the Customer.

    3. WodGuru is the entity to which the Customer entrusts the processing of personal data of Users and Club Members, and therefore, as processor, may process such data only to the extent and for the purpose set forth below and in connection with the provision of the Services set forth in the Terms of Service. The processing of personal data by WodGuru in its capacity as processor shall take place only during the term of the Entrustment Agreement concluded with the Customer. 

    4. Personal Data shall be processed by WodGuru as part of the Customer’s use of the System. At the same time, the Customer, User and Club Member by accepting the Policy agrees to WodGuru’s processing of their personal data.

  1. PURPOSE AND BASIS OF PROCESSING

    1. WodGuru, acting as an Administrator, processes the data of Customers in order to perform the Services described in the Terms and Conditions, including ensuring their proper quality, as a result of gaining access to the System by indicating the required personal data, in particular in order to provide these persons with the ability to communicate with WodGuru. 

    2. WodGuru acts as an Administrator of the personal data of Users and Club Members only for the purposes of direct communication in terms of recognizing complaints and handling inquiries (“help desk”).

    3. Personal data of Customers, Users and Club Members is processed in order to monitor the correctness of the performance of the Services under the Terms and Conditions, as a Contract concluded with the Customer for the entire period of its duration on the basis of Article 6(1)(b) of the RODO (the Terms and Conditions is a legal instrument identical to a contract).

    4. In addition, WodGuru processes personal data in order to:

      1. fulfillment of WodGuru’s legally incumbent obligations – for the duration of performance of such obligations, or for the period of time during which the processing of data is mandated by law, or for the period of time during which WodGuru may suffer the consequences of failure to perform a legal obligation, based on Article 6(1)(c) of the RODO (e.g. accounting and tax obligations and information on the course of providing the Services);

      2. to assert their rights or protect themselves against claims by Users’ and Club Members’ Customers, as well as third parties (Art. 6. 1. f RODO),

      3. to provide payment services, (art. 6.1.f RODO)

      4. direct marketing of own services in the sense of collecting and analyzing data in order to build a database of potential recipients of newsletter messages and assess their needs and preferences, within the framework of WodGuru’s legitimate interest consisting in protection of rights on the basis of Article 6(1)(f) RODO;

      5. to respond to inquiries made through the contact information provided in the System and further related correspondence, either via email or other forms of communication (Article 6(1)(f) RODO);

      6. conclusion and execution of agreements concluded with WodGuru, as well as their settlement and performance of activities aimed at concluding agreements, i.e. issuing invoices and accounting documents, maintaining access to the System of the Customer, User and Club Member, provision of electronic services by WodGuru under the agreement with the Customer, technical support (including “help desk”) (Article 6(1)(b) RODO);

      7. complaint handling, including technical troubleshooting (Article 6(1)(f) RODO legitimate interest of WodGuru to protect the rights of the Administrator and the User);

      8. generating cookies, collecting data from websites or for marketing purposes, including direct marketing, i.e. receiving by means of remote communication (e-mail, SMS, telephone) all materials of a commercial, marketing and informational nature, related to the business activity conducted by WodGuru, (legal basis – Article 6(1)(a) RODO).

    5. Provision of personal data is voluntary, but failure to provide some of the required data may result in our inability to perform the Services or respond to inquiries directed to WodGuru.

    6. A Customer, User and Club Member may withdraw their consent to the processing of personal data at any time, which will not, however, affect the legality of the use of the data during the period from the granting of consent until its withdrawal.

  1. In order to provide the Services, WodGuru processes the following personal data of the Customer:

  6. e-mail address, used for registration, identifying the Customer;

  8. street;

  9. house number;

  10. postal code;

  11. city;

  12. bank account number

  1. In addition, WodGuru uses IP addresses collected during Internet connections for technical, server administration purposes, which are also used to collect general, statistical demographic information (e.g., the region from which the connection is made).

  1. TYPE OF PERSONAL DATA OF THE USER AND CLUB MEMBER PROCESSED

  1. In order to provide the Services, WodGuru processes the following personal data of the User / Club Member:

  3. surname;

  4. e-mail address, used for registration, identifying the User/Club Member;

  5. the position/function held with the Customer in the case of a User;

  6. telephone number;

  7. street;

  8. house number;

  9. postal code;

  10. city;

  11. gender;

  12. photo;

  1. In terms of payment for the services offered by the Customer, the Customer also instructs WodGuru to process data on Club Members’ means of payment in the form of:

  1. credit card expiration dates;

  2. the last four digits of the credit card numberj;

  1. In addition, WodGuru uses IP addresses collected during Internet connections for technical, server administration purposes, which are also used to collect general, statistical demographic information (e.g., the region from which the connection is made).

  1. OBLIGATIONS RELATED TO THE PROCESSING OF PERSONAL DATA

  1. The Customer, User and Club Member is obliged to indicate to WodGuru complete, current and true data. 

  2. The Customer, User and Club Member is obligated not to provide WodGuru with personal data of third parties. If, on the other hand, he/she does provide such data, he/she each time undertakes and guarantees that he/she has a legal basis for providing such data.

  1. CONTROL OF PERSONAL DATA PROCESSING 

  1. The Customer, User and Club Member has the right to access the content of their data and the right to rectify, delete, limit processing, the right to data portability, the right to object to data processing based on the legitimate interest of WodGuru. Exercising the rights set forth in the paragraph above may be exercised in the case of deletion of data in the first place by ceasing to use the System, and further by sending an appropriate request to the e-mail address info@wod.guru with the name and electronic mail (e-mail) address.

  2. The Customer, User and Club Member has the right to lodge a complaint to the supervisory authority in case he/she considers that the processing of his/her personal data violates the regulations related to personal data processing, including RODO.

  1. RECIPIENTS OF PERSONAL DATA

  1. Customer, User and Club Member data may be shared with entities entitled to receive them under applicable laws, including relevant judicial authorities. Personal data may be provided to entities processing them on behalf of WodGuru, that is, partners providing services related to hosting, administration, maintenance and management of the WodGuru System and Services, external entities providing ICT support services, companies providing electronic payment intermediation services, external accounting firms, lawyers, state authorities authorized to do so under separate regulations (tax offices, courts, bailiffs, etc.).

  2. In addition to this, in providing the Services, WodGuru uses subcontractors for hosting services, site administration as well as potentially others with whom a relationship will be established in connection with the expansion or modification of the Services.

  1. DATA STORAGE PERIOD AND OTHER INFORMATION

  1. Personal data will be kept only for the period necessary to fulfill the specific purpose for which they were collected, i.e. to carry out the provisions of the Terms and Conditions and for the purpose of compliance with the law. 

  2. Personal data of Customers, Users and Club Members will be kept by:

  3. the duration of the use of the System by the Customer, User, Club Member,

  4. the period of cooperation between WodGuru and the Customer for whom the User works, or

  5. until the withdrawal or modification of the granted consent, if the processing is based on consent, 

  6. the time necessary for other purposes.

  1. Personal data will be kept also after the above-mentioned periods for the period required by applicable laws or the period needed by WodGuru to protect or assert its rights.

  2. In the event of termination of the Terms and Conditions, resulting in the discontinuation of use of the System by a Customer, User, Club Member, WodGuru will delete, without the possibility of their subsequent recovery, the information stored therein, including any personal data.

  1. COOKIES POLICY

  1. Cookies, also known as “cookies”, are text files saved and stored in the memory of the device used to browse the website (e.g. PC, notebook, tablet, PDA, cell phone). These files, once stored, are linked to a server or servers gaining appropriate access to them.

  2. WodGuru uses cookies for purposes of:

    1. statistics,

    2. configuration of the WodGuru System – allow setting features and services according to the preferences of Customers, Users and Club Members,

    3. authentication – allow to inform when a Customer, User, Clubber access the System, so that the site can show relevant information and features;

    4. analysis and research of behavior of Customers, Users and Club Members – they allow to read preferences and through their analysis to improve and develop products and services; 

    5. personalization of advertisements – they allow matching advertisements to demographic characteristics of customers, their interests, needs or preferences

  3. The collection of information is done anonymously, without identifying the personal data of individual Customers, Users and Club Members unless the settings of the end device allow such identification.

  4. By changing the settings of the software used to use the WodGuru System, it is possible to determine the conditions for storing and accessing cookies used by the System, in particular the possibility to completely disable them. Note, however, that deletion or blocking of files called “cookies” may be associated with the fact that some sections of WodGuru will not function properly. In order to change the settings related to the handling of cookies, you should properly configure the software used to use the WodGuru System. Relevant information in this regard can be obtained from the technical support for such software or by contacting its provider. Failure to change the settings of your software constitutes, pursuant to Article 173(2) of the Telecommunications Act, your consent to the WodGuru System’s use of cookies for the purposes specified above.

Due to the continuous development and advancement of technology, the rules set forth in the Policy are subject to change. You will be informed of changes to these policies in good time, no later than 7 days prior to their implementation, by posting the new content of this document on the website https://wod.guru/privacy/.
